My Struggle with Legal Terrorism

Days passed;
I was going to office as usual;
Every month there court dates; but she never came to court; as judge also never asked Public prosecutor to produce her; nor my lawyer asked;

Every Date I was present and waiting for my name to call; Whole day I have to wait on door of court room, and when my name called just show my face to judge and he will give another date; this is how Indian Court Harass, most of the cases never reach any solution or judgments; As everyone knows LAW is Blind but
Indian law is not only BLIND but DEAF and DUMB too.

On 27th October 2000 Friday; I was watching some English Movie on Star Movies.
At 10.30 my door bell rung; I thought, they came again for something as they used to come at night only to harass me, insult me.

I Opened the door chain on, so they cannot come in; when I saw, they were not there, instead 3 men were standing; I could not see their face clearly as there was no direct light other than faint zero volt bulb. They were look like street guys and unknown.

I said “YES??? as I have not seen them before.

One of them, asked in Hindi, idhar D’souza kidhar rehetha hai?
As there were 2 more D’souza family on my same floor, so I asked them again;
Kaunsa D’souza?
They were confused, as they did`t remembered first name.
Then third fellow who was standing behind two guys in front asked;
Sunita ka husband..

Now I knew, they came for me.

So I asked
Main hoon, kya hua..

They tried to push the door to open, even one guy kept his foot between doors, so I could not close it.

Bahut charbi hai thereko,
thereko sikayega, bahar aa, thera moo pe acid pekega..

They just keep on saying anything,

I pushed the door to close, as I knew now, they were sent by my wife’s sister who killed her own Brother to get marry a man, because her brother was against her union.

All of a sudden they stopped pushing door and just fade away;

I was surprised why they left, they I came to know that some was coming up stair talking, so they left all of a sudden.

I went gallery, from there I can see, who is coming to our building;

When I saw down; those three men were walking away from our building and there was Red maruthi Omni was waiting for them.

I could not sleep that night;

Next day morning I wakeup early, and went to meet Vasai priest and told him everything; he advised me to leave Vasai and go somewhere.

There was no time to shift my things from home, so I kept everything as it is. Just closed all windows and door, and locked house and went in hiding, even telling neighbors my parents or my office colleagues.

No one knew where I went.

I was contacting my office colleague Sameer Nair and asking him to contact my lawyer to find out next court dates. As I was getting dates after dates in her absence.

  1. In an interesting turn of events , there seems to be some hope for families who have been struggling with false 498a charges .
    A.Singh a resident of Ghaziabad had a set back when the false 498a case registered by her was dismissed by the U.P court . This is a typical case where an NRI groom was trapped by a family just to extract some money .

    A.Singh had filed false dowry charges against the Gupta family and demanded a hefty amount of money as legal extortion to drop the charges , however the Gupta family stood their ground and fought the legal battle .
    After 3 years of intense legal battle the Gupta family won the case .
    This is a perfect example where NRI grooms are subjected to false 498a charges , just to extract money .
    This win by the Gupta family brings in some hope to people struggling with these false charges .
    In a nut shell , the basic survival to 498a is pure patience . Initial days are full of struggle , but once you get the hang of it , you will be able to fight your way out .
