JUDGEMENT
This is a petition filed by the petitioner U/s.12 of Protection of Women from Domestic Violence Act, 2005 seeking relief’s U/s.18, 19, 20 and 22 of the said Act.

2. The case of the petitioner in brief is as under:

It is the case of the petitioner that she was married to respondent on 09-11-2012 at H.V.R Kalyana Mantapa, Magadi Road, Bangalore as per Rites and Customs prevailing in their community. It is submitted that after the marriage, the petitioner and the respondent went to respondent’s rented house at Annapoorneswari Nagar, Bangalore they lived together in the said house and the petitioner had discharged her marital obligations towards the respondent as a dutiful wife. It is submitted that just two days after the marriage, the respondent demanded a sum of Rs.2,00,000/- as dowry from the parents of the petitioner. However, the petitioner convinced the respondent to wait for some time as the marriage was performed only two days before and her parents should come out from the financial crisis as they spent huge sum for the marriage. In spite of the above the respondent has continued with the same attitude and developed hatred attitude towards the petitioner. He also started humiliating the petitioner every day and started harassing the petitioner mentally, emotionally, verbally and physically. It is submitted that after 25 days of the said accident, the neck chain which was given by the parents was missing in his neck. When the petitioner asked about the neck chain, the respondent has stated that since the petitioner has failed to bring the dowry, and since the respondent has huge loans, he has pledged the said chain to clear the said loan and further threatened the petitioner that she shall not question him and if she questions the respondent, he will send the petitioner to her parents house. It is submitted that every day, without any reasons and no fault of the petitioner, the respondent picks up the quarrel with the petitioner and used to humiliate the petitioner stating that her parents have no capacity to pay a sum of Rs.2,00,000/- as dowry and if he were married to some other girl, he would have got heavy dowry and subjected the petitioner to verbal and mental cruelty. It is submitted that the respondent has no faith in the petitioner and he always suspecting the fidelity of the petitioner, he used to suspect that the petitioner had physical relationship with other man, and therefore, the respondent forced the petitioner to undergo a body check up at the Unity Lifeline Hospital (India) Pvt. Ltd., Nagaraghavi, on 07-12-2013. It is further submitted that the respondent has not allowed the petitioner to use the mobile phone suspecting that the petitioner may reveal his mis-deeds to her parents. The petitioner was also not allowed to visit the house of her parents and any of her relatives. It is submitted that due to the strange attitude of the respondent, the petitioner took the respondent to the Unity Lifeline Hospital (India) Pvt. Ltd., Nagarabhavi, Bangalore on 18-01-2013, for counseling and explained the said attitude of the respondent. After counseling the doctor prescribed the respondent to take “Sizodon Plus’ tablets and further advised him to visit continuous treatment however the respondent never turned towards the hospital. It is submitted in addition to respondent’s mental, verbal and physical torture; the sister of the respondent Dhanamma, his brother-in-law Narayanaswamy used to call the petitioner on phone and demanding the petitioner to bring Rs.2,00,000/- as dowry. Apart from them the respondent’s elder brother Raghu and nephew Balakrishna used to visit the house and used to make the respondent quarrel with the petitioner regarding dowry amount and thereby caused mental cruelty to the petitioner. It is submitted that, without any alternative the petitioner went to her parents house and explained the above said incident, however the petitioner parents refused to lodge the complaint against the respondent and his family members only with an intention to save the marriage of the petitioner and respondent and the parents of the petitioner were also trying the mobilize the dowry amount demanded by the respondent and his family members. The petitioner and her parents were tried to find out the resident of respondent has vacated the said rented house without disclosing his whereabouts to the petitioner. In the circumstance above, on 30-06-2013, the petitioner approached the Jnanabharathi police and lodged a complaint against the respondent, his sister, brother-in-law, elder brother Raghu, and nephew Balakrishna. On receipt of the said complaint, the police have called the respondent to the police station, in spite of the counseling made by the police the respondent has refused to mend himself and refused to take back the petitioner to the matrimonial house. On the other hand the respondent is working as a contractor in Hindustan Aeronautics Ltd., (H.A.L.) and he is drawing a salary a sum of Rs.50,000/- p.m. As such she prayed for a protection order U/s.18 and residence order U/s.19, monetary relief of Rs.10,00,000/- towards compensation and maintenance as this court deems fit.

3. After registration of the case, summons was issued to the respondent and he appeared through his counsel and filed detailed statement of objection denying each and every allegations made against him.

4. In order to substantiate their respective contentions, the petitioner got examined herself as P.W.1 and got marked 16 documents as Ex.P.1 to Ex.P.16. The respondent got examined himself as R.W.1 and did not mark any documents on his behalf.

5. Heard arguments on both the sides, perused the petition, objection and available materials on record.

7. On perusal of materials before this court, My findings on the above said points are as under:

POINT No.1: To file a petition U/s.12 of the Act, it is necessary that the petitioner has to establish two things firstly, she must establish that, the petitioner and respondent or respondents lived or are living together, in a domestic relationship. Secondly, that the respondent or respondents have subjected her to acts of domestic violence. To prove the domestic relationship the petitioner is required to prove that she and the respondents have lived together in a relationship of marriage or in a relationship in the nature of marriage or related by consanguinity or adoption or as family members living together as a joint family. To prove the act of domestic violence the petitioner is required o prove any one or more of the acts committed by the respondent or respondents as contemplated U/s.3 of the Act.

9. In the present case the petitioner got examined herself as P.W.1 and got marked 16 documents from Ex.P.1 to Ex.P.16. The respondent has not disputed the marital status since the respondent has admitted the marriage and paternity the relationship between the petitioner and respondent is not in dispute and hence the said point is not seriously contested.

£Á£ÀÄ CfðzÁgÀgÉÆA¢UÉ «ªÁºÀªÁVzÀÝgÀÆ ¸ÀºÀ ¨sÁgÀw JA§ÄªÀAvÀºÀ ªÀÄvÉÆÛAzÀÄ ªÀÄ»¼ÉAiÉÆA¢UÉ PÉʪÁgÀzÀ°è «ªÁºÀªÁVgÀÄvÉÛãÉAzÀgÉ ¸ÀjAiÀÄ®è. ¸ÀzÀj ªÀÄ»¼ÉAiÉÆA¢UÉ ¨ÉAUÀ¼ÀÆj£À°è ªÁ¸À«zÉÝãÉAzÀgÉ ¸ÀjAiÀÄ®è. CfðzÁgÀjUÉ zÉÊ»PÀªÁV ªÀÄvÀÄÛ ªÀiÁ£À¹PÀªÁV QgÀÄPÀļÀ ¤Ãr ªÀģɬÄAzÀ DZÉ ºÁQgÀÄvÉÛÉãÉAzÀgÉ ¸ÀjAiÀÄ®è. ¸ÀzÀj «ZÁgÀªÁV ¸ÀļÀÄî ¸ÁQë £ÀÄrAiÀÄÄwÛzÉÝãÉAzÀgÉ ¸ÀjAiÀÄ®è. £À£Àß ªÀÄÄRå«ZÁgÀuÉAiÀÄ ¥ÀæªÀiÁt ¥ÀvÀæzÀ ¥sÁågÀ 06 gÀ°è ºÉýgÀĪÀAvÉ ¸ÀzÀj CA±ÀUÀ¼ÀÄ ¸ÀĽî¤AzÀ PÀÆrgÀÄvÀÛzÉ JAzÀgÉ ¸ÀjAiÀÄ®è. £À£Àß ªÀÄÄRå«ZÁgÀuÉAiÀÄ ¥ÀæªÀiÁt ¥ÀvÀæzÀ ¥sÁågÀ 09, 10, 11, 12 gÀ°è ºÉýgÀĪÀAvÉ ¸ÀzÀj CA±ÀUÀ¼ÀÄ ¸ÀĽî¤AzÀ PÀÆrgÀÄvÀÛzÉ JAzÀgÉ ¸ÀjAiÀÄ®è. gÀªÉÄñï JA§ÄAªÀvÀºÀ ªÀåQÛ¬ÄAzÀ £À£ÀUÉ fêÀ ¨ÉzÀjPÉ EzÀÄÝ ¸ÀzÀjAiÀĪÀgÀ «gÀÄzÀÝ £Á£ÀÄ AiÀiÁªÀÅzÉà zÀÆgÀ£ÀÄß zÁR°¹gÀĪÀÅ¢®è.

12. On perusal of these depositions it is clear that relationship between the petitioner and respondent is not in dispute. The petitioner has failed to prove the respondent has harassed her. However no specific allegations are being made against the respondents so as to prove the act of Domestic Violence. Mere allegations which are not specific and which are vague in nature cannot be accepted as proof of Domestic Violence.

13. When such being the case, the infliction of domestic violence made against the respondents gets diluted and same cannot be accepted. The Protection of Women from Domestic Violence Act 2005 is beneficiary legislation and is intended to protect the interest of wife. In order to claim any relief under the said Act, must satisfy and prove before this Court that she is an aggrieved woman U/s.2(a) of the said Act and she has been subjected to domestic violence as defined U/s.3 of Domestic violence Act. Hence on perusal of the evidence of P.W.1 it establishes that except the vague allegations made against the respondent, the petitioner has not proved her case of domestic violence against him.

14. The petitioner has prayed for a protection order U/s.18 of the Act. As discussed above the petitioner has failed to prove the fact of Domestic Violence by the respondent on her. Such being the case, this court cannot relief under the Sec 18 of the Act. Apart from the self serving statements in the petition and her examination in chief the petitioner has failed to substantiate by producing cogent documents or iota evidence to prove her case. Thus, she is not entitled for the relief U/s.18 of the Act.

15. The petitioner has prayed for a direction against the respondents to provide for residence order U/s.19(1) (F) and Sec 19(8) of the Act. Such being the case, this court cannot relief under the Sec 19 of the Act. Apart from the self serving statements in the petition and her examination in chief the petitioner has failed to substantiate by producing cogent documents or iota evidence to prove her case. Thus, she is not entitled for the relief U/s.19 of the Act.

16. The petitioner has sought for a direction against the respondent for the compensation of Rs.10 Lakhs and maintenance as this court deems fit. No doubt the petitioner has not proved ingredients of the protection of women from domestic violence act, but still the respondent is held respondent to pay compensation of Rs.2,00,000/- to petitioner. As respondent being the husband of petitioner, he is bound to discharge his duty as husband of petitioner as per the Hindu Law. Hence, I answer Point No.1 PARTLY IN THE AFFIRMAIVE.

17. POINT No.2: In view of the materials placed before this court, pleadings, depositions and documentary evidence, this court proceeds to pass the following:

ORDER The petition filed by the petitioner U/s.12 of Protection of Women fromDomestic Violence Act 2005, is allowed in part.
The protection order U/s.18 of Act is hereby rejected.
The residence order U/s.19 of Act is also rejected.
Further the respondent is directed to pay to the petitioner Rs.2 Lakhs (Rupees Two Lakhs) as compensation.
The claim of maintenance for the petitioner is hereby rejected.
No order as to costs.
Office is directed to furnish copy of this order to both the parties at free of cost.
