1. Petitioners have preferred this misc. petition under
Section 482 of Cr.P.C. for quashing of the FIR No.34/2017
registered at Police Station Thnwala, and all further proceeding
initiated in pursuant thereof, for the offence falling under sections
498A, 406 323 of IPC.
2. The array of 13 petitioners show that the complete
family was arrayed as accused persons by the complainant. The
concern of this Court has been met with from the investigation
report which has concluded that the offence has been found to be
prima facie made out only against Ramkunwar, Shivji Ram
Santoshi Devi. Since the prima faice offence has not been made
out against rest of the petitioners and the investigation is
complete, therefore, in the opinion of this Court no further
adjudication is required under Section 482 of Cr.P.C.
3. However, both the parties shall be free to make
representations before the investigating authority regarding their
remaining issues and the investigating authority shall consider the
issue raised by the parties for completion of the investigation.
4. Consequently, this misc. petition is disposed of.
