The present second application for bail has been filed under

Section 439 Cr.P.C. on behalf of the petitioner, who is in custody in

relation to F.I.R. No.15/2014, Police Station Bhinmal, for the

offences under Sections 498A and 304B I.P.C.

Heard learned counsel for the petitioner and learned Public

Prosecutor. Perused the material available on record.

Having regard to the entirety of facts and circumstances as

available on record and considering the fact that the petitioner is

the husband of the deceased Smt.Indra, who committed suicide in

her matrimonial home within a period of three years of her

marriage, while she was carrying a child in her womb and since

allegations of her being treated with cruelty appear in the

statements of the prosecution witnesses, I am not inclined to

enlarge the petitioner on bail.

Accordingly, this second bail application preferred on behalf

of the petitioner under Section 439 Cr.P.C. is dismissed as being

devoid of merit. Considering the fact that the petitioner is in

custody from 24.1.2014, trial Court is directed to expedite the

trial.
