ORDER

1.Petitioner is the accused in crime no.525/2017

of the Taliparamba police station. He is alleged

to have committed an offence punishable under

Sec.498A of IPC. He seeks bail under Sec.438 of

Cr.P.C.

2.Heard the learned counsel for the petitioner and

the learned Public Prosecutor.

3.The petitioner is the husband of the first

informant. She filed a complaint against him

alleging harassment. She alleges mental and

physical harassment. Admittedly there are

matrimonial disputes between the spouses. No

injury is seen to have sustained by the first

informant going by the papers in the case diary.

The possibility of repairing the matrimony

should also be kept in mind. In these

circumstances I am inclined to grant bail under

Sec.438 of Cr.P.C.

4.The application is allowed. The petitioner

shall be released on bail after interrogation

on his executing a bond for Rs.30,000/- with

two solvent sureties each for the like sum in

the event of his arrest in connection with

crime No.525/2017 of the Taliparamba police

station. The petitioner shall co-operate with

the investigation. He shall make himself

available for interrogation as and when

required by the investigating officer. He

shall report to the investigating officer

between 10.00 am and 11.00 am on every Tuesday

for a period of two months or till the filing

of the report under Section 173(2) of the

Cr.P.C, whichever is earlier. The petitioner

shall not intimidate or try to influence

witnesses; nor shall he destroy evidence or

tamper with it. The court concerned is hereby

empowered to cancel the bail in the event of

violation of any of the conditions mentioned

above. The petitioner shall not leave the

country without the permission of the court

concerned.
