ORAL ORDER

(PER : HONOURABLE SMT. JUSTICE ABHILASHA KUMARI)

1. Rule. Mr.J.K.Shah, learned Additional Public Prosecutor

waives service of notice of Rule on behalf of respondent State.

2. The applicant has moved this application with a prayer to

release her on temporary bail for a period of 30 days. The

applicant is undergoing life imprisonment for the offences

punishable under Sections 302, 114 and 498A of the Indian

Penal Code.

3. In her application dated 22.05.2017, the applicant has

submitted that her mother and two sisters are in jail and only

her father and brother are residing at her house. It is further

submitted matrimonial talks are going on regarding the

marriage of the applicant and her presence would be required

at the home to give consent to the marriage proposal that has

been arranged by her father.

4. Having considered the averments made in the application

and perused the jail remarks, it is found that the applicant has

been released on temporary bail twice on previous occasions

and has surrendered in time. Further, the conduct of the

applicant is stated to be good.

5. Hence, we deem it proper to pass the following order.

The applicant shall be released on temporary bail for a

period of 15 days from the date of her actual release

upon furnishing personal bond of Rs.5,000/- (Rupees Five

Thousand only) and upon the usual terms and conditions,

to the satisfaction of the concerned Jail authority.

Upon expiry of the aforesaid period, the applicant shall

surrender before the concerned Jail authority forthwith.

6. The application is allowed, in the above terms. Rule is

made absolute to the above extent.
