Prayer in this petition is for grant of anticipatory bail to the
petitioner in FIR No.93 dated 28.07.2015 under Sections 498A/323/427/506/
34/406 IPC (the offence punishable under Section 406 IPC added later)
registered at Police Station Division No.4, Jalandhar.
It is submitted that during the pendency of this petition, the matter
has been amicably resolved between the parties. The petitioner and
respondent No.2 have decided to part ways. A petition under Section 13B of

the Hindu Marriage Act, 1955 has been filed. Statements of the parties at first
motion have been recorded and the matter is listed for 21.09.2017 for
recording the statements of the parties at second motion. It is submitted that
the petitioner as well as respondent No.2 shall remain bound by the terms and
conditions of the settlement arrived at between them.
Learned counsel for respondent No.2 affirms and verifies the
factum of settlement between the parties as well as filing of the petition under
Section 13B of the Hindu Marriage Act, 1955. It is submitted that in view of
the settlement arrived at between the parties, there is no objection on behalf of
the complainant/respondent No.2 to the grant of anticipatory bail to the
petitioner.
Learned counsel for the State verifies that the petitioner has joined
investigation pursuant to order dated 16.11.2015 passed by this Court.
Keeping in view the facts and circumstances as above and
specifically the settlement between the parties but without commenting upon
or expressing any opinion on the merits of the case, this petition is allowed.
Consequently, order dated 16.11.2015 is made absolute.
