In this application under Section 24 of the Code of Civil
Procedure, 1908 the petitioner wife has prayed for, transfer of the
Misc. Case No. 3 of 2017, filed by the opposite party husband under
Section 25 of the Guardians and Wards Act, 1890 claiming custody of
the minor child and pending before the Court of the learned District
Judge, North 24-parganas at Barasat to the Court of the learned
District Judge at Hooghly.

It is the case of the petitioner that the minor child whose
custody is sought for by the opposite party husband is only nine
months old.

Considering the facts of the case, I find that the interest of
justice would be sub-served to both the parties to this application if

the case is transferred to the Court of the learned Chief Judge, City
Civil Court at Calcutta.

Accordingly, the Misc. Case No. 3 of 2017 (Suvam Gupta vs.
Koyel Gupta) is withdrawn from the Court of the learned District
Judge, North 24-Parganas at Barasat and the same is transferred to
the Court of the learned Chief Judge, City Civil Court at Calcutta.

The learned District Judge, North 24-Parganas is directed to
forthwith transmit all the records of the Misc. Case No. 3 of 2017
(Suvam Gupta vs. Koyel Gupta) to the Court of the learned Chief
Judge, City Civil Court at Calcutta.

With the above directions, the revisional application, being C.O.
1553 of 2017, stands disposed of.

There shall, however, be no order as to costs.
Urgent certified website copies of this order, if applied for, be
made available to the parties upon compliance of all requisite
formalities.
