1. The present bail application has been filed under

Section 439 of Cr.P.C. on behalf of the petitioners who are in

custody in connection with FIR No.126/2017, P.S. Dhorimana,

District Barmer, for the offence under Sections 147, 148,

458, 498A, 323, 354, 366, 307/149 of IPC.

2. Counsel for the petitioners argued that during the

investigation, statement of Maina Devi was recorded under Section

164 of Cr.P.C. in which the names of the present petitioners have

not been disclosed and petitioners have been falsely implicated in

this case. Petitioners are in judicial cusotdy since 12.06.2017. In

view of above, the petitioner may be enlarged on bail.

3. Learned Public Prosecutor has opposed the bail

applications.

4 Heard learned counel for the petitioners and the

learned Public Prosecutor and perused the material available on

record.

5. Having regard to the facts and circumstances of the

case and upon a consideraton of the arguments advanced at the

Bar, this Court is of the opinion that the bail application filed by

the petitioners deserve to be accepted.

6. Consequently, this bail application of the accused-

petitioners are allowed. It is ordered that the accused-petitioner

(1) Mangilal S/o Manphulram, (2) Ramjeevan S/o

Kachbaram @ Kachuram, arrested in connection with FIR

No.126/2017, P.S. Dhorimana, District Barmer, shall be

released on bail; provided each of them furnish a personal bond of

Rs.50,000/- and two surety bonds of Rs.25,000/- each to the

satisfaction of the learned trial court with the stipulation to appear

before that Court on all dates of hearing and as and when called

upon to do so.
