This bail application under Section 439 Cr.P.C is laid by the

petitioner in connection with an FIR No.33/2017 lodged in Police

Station Kurabad District Udaipur for the offences punishable under

Sections 498A 306 IPC.

The contention of the learned counsel for the applicant is

that the alleged offences against the applicant is one under

Section 306 IPC with the aid of Section 34 IPC. The Co-accused is

the brother of the applicant Nana @ Nanuram Meena has already

been granted bail by this Court on 09.05.2017. Charge sheet for

offences under Sections 306/34 against both the accused has

already been filed. The accused in the jail for more than four

months and the trial has take time.

Learned Public Prosecutor and learned counsel for the

complainant have opposed the bail application.

Having heard learned counsel for the parties and after

considering the fact and circumstances and without expressing

any opinion on merits of the case, I deem it just and appropriate

to grant indulgence to the petitioner by enlarging them on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is

allowed and it is ordered that accused-petitioner Mohan Lal Meena

S/o Sh.Deva Ji Meena arrested in connection with F.I.R.

No.33/2017 Police Station Kurabad District Udaipur may be

released on bail; provided he furnishes a personal bond of

Rs.50,000/- with two surety bonds of Rs.25,000/- each to the

satisfaction of learned trial Court with the stipulation to appear

before that Court on all dates of hearing and as and when called

upon to do so.
