This bail application under Section 439 Cr.P.C. is laid by

petitioner in connection with an FIR, wherein she is charged for

offences punishable under Sections 304B 498A IPC.

It is submitted by learned counsel for the petitioner that

there is no direct evidence against petitioner for commission of

alleged offences. It is also argued by learned counsel that

Histopathological Report makes it crystal clear that utilisation of

rodenticide/insecticide and Pesticides usually suicidal, occasionally

accidental and rarely homicidal. Learned counsel has also

submitted that petitioner is a lady and after completion of

investigation, charge-sheet in the matter has already been filed,

therefore, a benevolent view in the matter for grant of bail is

desirable.

Learned Public Prosecutor has opposed the bail application.

Having heard learned counsel for the parties and taking into

account facts and circumstances of the case, without expressing

any opinion on merits of the case, I deem it just and appropriate

to grant indulgence to the petitioner by enlarging her on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is

allowed and it is ordered that accused-petitioner, Saraswati W/o

Sh. Keshra Ram, arrested in connection with F.I.R. No.56/2016,

Police Station Kalu, District Bikaner, may be released on bail;

provided she furnishes a personal bond of Rs.50,000/- with two

sureties of like amount to the satisfaction of learned trial Court

with the stipulation to appear before that Court on all dates of

hearing and as and when called upon to do so.
