This criminal petition is filed under Section 439 of
Cr.P.C praying to enlarge the petitioner on bail in the
event of their arrest in Crime No.11/2017 of

Holenarasipura Town P.S., Hassan District for the
offences punishable under Sections 498A, 304B, r/w 34
of IPC.

This Criminal Petition coming on for Orders
this day, the Court made the following:

ORDER

Heard learned counsel for the petitioner and the

learned High Court Government Pleader for the

respondent-State.

2. The petitioner-accused No.1 along with his

parents are chargesheeted by the respondent-police in

Crime No.11/2017 in respect of the offences punishable

under Sections 498A, 304B r/w 34 of IPC and Section 4

of the Dowry Prohibition Act.

3. The allegation is, the deceased and the

petitioner after their marriage, lived happily together for

six months. Thereafter, accused persons harassed the

deceased for dowry of Rs.1,00,000/- from her parent’s

house. Despite advise made by the panchayathdars,

they did not heed, they threatened the deceased to get

Rs.1,00,000/-, otherwise to die by consuming

pesticides, so that, her husband can marry again. That

prompted the deceased to consume poison during night

of 12.01.2017 and she died while taking treatment in

the hospital on 13.01.2017.

4. Perused the prosecution papers. The post

mortem report does not depict marks of violence on the

dead body. The petitioner is in judicial custody for last

seven months.

5. Having regard to the nature of allegation, it

is not warranted to continue the petitioner in judicial

custody during the trial period.

6. Accordingly, petition is allowed. Petitioner is

enlarged on bail in connection with Crime No.11/2017

registered by the respondent-Police, subject to the

following conditions:

(i) He shall execute a self bond for a sum of
Rs.1,00,000/- (Rupees One lakh only)
with one local surety for the likesum to
the satisfaction of the concerned Court;

(ii) He shall attend the Court regularly on
all hearing dates; and

(iii) He shall not prevail upon or threaten the
prosecution witnesses.
