On 20.06.2017, three weeks’ time was granted for filing
counteraffidavit. On the request of Mr. T.N. Verma, the
learned Spl. PP, two weeks’ further time was granted on 17.07.2017,
however, no affidavit has been filed in this case.
Heard the learned counsels appearing for the parties and
perused the documents on record.
The petitioner has been made an accused in Palajori P.S.
Case No.17 of 2011, registered for offences punishable under
Sections 162/163/165(a) IPC and u/s 7/9/13(1dii) of Prevention
of Corruption Act. A chargesheet has been filed against the
petitioner and other coaccused for the offence under
Section 406 IPC and u/s 7/9/13(1dii) of Prevention of Corruption
Act. It is alleged that the petitioner was a middleman. Allegation
is that the petitioner and the Panchayat Sevak did not pay the total
amount to the beneficiary. The petitioner is in judicial custody since
Mr. T.N. Verma, the learned Spl. PP has referred to the
allegation in the First Information Report and order
dated 03.06.2017 by which prayer for bail was declined by the
learned Special Judge (ACB), Dumka.
Having regard to the facts and circumstances of the case,
the petitioner, Sukhdeo Mohali, is directed to be released on bail on
furnishing bail bond of Rs.10,000/(Rupees ten thousand) with two
sureties of the like amount each to the satisfaction of the
Learned Special Judge (ACB), Dumka in connection with Palajori P.S.
Case No.17 of 2011, corresponding to Vigilance Case No.21 of
