This Criminal Petition is filed under Section 439 of
Cr.P.C. praying to enlarge the petitioner on bail in S.C.
No. 38/2016 pending on the file of the Principal District
and Sessions Judge, Chamarajanagar and crime
No.11/2016 of Chamarajanagar Town Police Station,
Chamarajanagar which is registered for the offence

p/u/s 498a, 302, 304B, r/w 34 of IPC and Sec. 4 of
Dowry Prohibition Act.

This Criminal Petition is coming on for orders this
day, the Court made the following:

ORDER

The petitioner (Accused No. 2) along with her son,

accused No.1, is charge sheeted by the respondent

police in respect of the offences punishable under 498a,

302, 304B, read with 34 of IPC and Section 4 of Dowry

Prohibition Act.

2. As per the submission at the bar, the trial is

in progress and already six witnesses are examined.

Without going into the merits of the case it suffices for

the present to consider, that the petitioner is said to be

suffering from hyper tension, immature cataract of both

eyes and she is advised for MRI scan (Brain), Thyroid

Profile and Random Blood Sugar.

3. Considering the letter of the Chief

Superintendent of Prisons, Central Prison of Mysore and

also the medical reports of the petitioner/accused No.2,

on humanitarian grounds, the application is considered.

Petition is allowed. Petitioner is enlarged on bail

on executing a self bond for Rs.1,00,000/- with one

local surety for the likesum to the satisfaction of the

concerned court. Further, she shall attend the court

regularly on all the hearing dates and shall not tamper

the prosecution evidence.
