with Raina Police Station Case No. 244 of 2016 dated 15.11.2016
under Sections 498A/302/34 of the Indian Penal Code.

Heard the learned counsel appearing on behalf of the
parties. Perused the Case Diary.
The petitioner is the husband. He is in custody for 281
days. Two other charge-sheeted accused, namely, brother-in-
laws are on bail. Earlier, the petitioner’s prayer for bail was
rejected about two months back. However, till date there has
been no progress in the case, except the submission of the
charge-sheet.
Having regard to the petitioner’s length of detention in
custody and the further fact that there has been no further
progress in the matter, after a Co-ordinate Bench of this court
rejected the petitioner’s prayer for bail two months back, except
submission of charge-sheet the case has not yet been committed

and when no apprehension has been disclosed from the side of
the State that if the petitioner is released on bail, he is likely to
abscond or his further custodial detention is necessary even after
submission of charge-sheet, the prayer for bail is allowed.
Let the petitioner be released on bail upon furnishing
Bond of Rs. 10,000/- with two sureties of Rs. 5,000/- each, one
of whom must be local, to the satisfaction of the Learned Chief
Judicial Magistrate, Burdwan.
The instant application for bail is, thus, disposed of.
