It is submitted on behalf of the petitioner that the impugned

F.I.R. relates to offences in respect of which an earlier F.I.R. being

Kashipur P.S. Case No. 192 of 2017 dated 10.05.2017 under sections

498A/406/323/34 of Indian Penal Code was instituted by the opposite

party no. 2 wife.

Let this matter appear under the heading ‘Motion Adjourn’ two

weeks after the ensuing Puja vacation.

Mr. Ayan Basu, learned counsel who ordinarily appears for the

State is requested to appear in this matter. Copy of the petition be

served upon him in course of the day. Copy of the petition also be

served upon opposite party no. 2 through registered post with

acknowledgement due and file affidavit of service on the next date of

hearing. Mr. Basu is directed to produce the case diaries of Kashipur

P.S. Case No. 192 of 2017 dated 10.05.2017 under sections

498A/406/323/34 of Indian Penal Code and Jangipara P.S. Case No.

130 of 2017 dated 02.06.2017 under sections 498A/406/506/34 of

Indian Penal Code on the next date of hearing. There shall be stay of

proceeding in G.R. 1325 of 2017 arising out of F.I.R. of Jangipara P.S.

Case No. 130 of 2017 dated 02.06.2017 under sections

498A/406/506/34 of Indian Penal Code now pending before the learned

Additional Chief Judicial Magistrate at Serampore, for a period of two

weeks after the ensuing Puja vacation or until further orders whichever

is earlier.

Liberty to pray for extension, modification, variation and/or

vacating the interim order upon notice to the other side.
