Prayer: Petition filed under Section 25 of the Guardian and Wards Act and Order XXI Rule 2 and 3 of Madras High Court Original Side Rules, 1956 to grant custody of the minor sons (1) Gautham Adithya born on 03.01.2006 (2) Nikhil Arya born on 18.02.2008 (3) Kavin Arjuna, born on 16.05.2010, respectively to the petitioner.

O R D E R
Very satisfactorily, the petitioner and the respondent had appeared before the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras and with the assistance of their counsels and also with the assistance of the mediators, Mrs Uma Ramanathan and Mr.A.J.Jawad, they had entered into a Memo of Compromise. The memo of compromise has been forwarded by the Mediation and Conciliation Centre, by letter dated 07.08.2017 to this Court.
2. According to the Memo of Compromise, the petitioner and the respondent have agreed that the custody of three minor children will be with the respondent Dr.G.Subha, who is residing at Flat No.116, Ramaniyam Kattima, Pillayar Koil Street, Thuraippakam, Chennai 97. It had also been agreed that, during the week days, during the school months, arrangements have been made with respect to picking up and dropping the children at a common place and not at the residence of the respondent. Detailed arrangements have been given in the memo of compromise. Further arrangements have been made with respect to the schedule during summer holidays, Pooja holidays and Christmas holidays and also on days wherein religious functions will be conducted. Arrangements have also been made with respect to celebration of birthdays and close family functions. There are also arrangements with respect to taking part in parent-teacher association meetings and general arrangements with respect to contacting children through phone. A monthly maintenance of Rs.30,000/- has also been agreed to be paid by the petitioner. There has also been an agreement with respect to renewal of passport. The respondent also agreed to withdraw M.C.No.22 of 2016 pending of the file of the IX th Metropolitan Magistrate Court, Saidapet, Chennai on the date of recording the evidence. They have further agreed that they will not seek alimony either past or future, from each other.
3. The memo of compromise is recorded. Accordingly, there will be a judgment and decree in O.P.No.267 of 2016. The memo of compromise shall form part of the decree in O.P.No.267 of 2016 .No costs. Consequently, application is closed.
