It is submitted on behalf of the petitioner that

uncontroverted allegations in the impugned charge sheet, inter

alia, show that the he is not a relation of the husband of the

opposite party no.2/wife and his role was restricted to

negotiation prior to marriage. Uncontroverted allegations do not

disclose ingredients of the alleged offences.

Let the matter be listed under the heading “Contested

Application” two weeks after the puja vacation.

A copy of the petition be served upon the opposite party

no.1 through Public Prosecutor, High Court, Calcutta and the

opposite party no.2 by the registered speed post with

acknowledgement due and file affidavit-of-service on the next

date of hearing.

There shall be stay of proceeding in GR Case No.1177 of

2014 arising out of Shakespeare Sarani Police Station Case

No.169 of 2014 under Sections 498A/406/420/120B of the

Indian Penal Code read with Section 3/4 of the Dowry

Prohibition Act pending before the Court of the Learned

Metropolitan Magistrate, 4th Court, Calcutta for a period of three

weeks after the puja vacation or until further orders, whichever

is earlier so far it relates to the petitioner. Proceeding shall

continue against other accused persons in accordance with law.

Liberty to pray for extension, modification, variation

and/or vacating the interim order upon notice to the other side.

Urgent certified photocopy of this order, if applied for, be

delivered to the learned Advocate for the petitioner, upon

compliance of all formalities.
