ORDER

Heard the learned counsel for the petitioner and

the learned High Court Government Pleader for the

respondent.

2. The petitioner apprehends arrest by the

respondent police in their Crime No.204/2017

registered in respect of the offences punishable under

Sections 498A, 323, 504, 506,114 of IPC and Sections 3

and 4 of Dowry Prohibition Act.

3. The complainant is none other than his wife.

The allegation is, the petitioner and complainant were

married as per the custom on 29.01.2015. Subsequent

to the marriage, a pre-mature baby was born to the

couple. The accused insisted the complainant to hand

over the child to the accused Nso.4 and 5 (their

relatives), since they are issue less. The complainant

since refused, she was tortured. While she conceived for

second time, she was again harassed by demanding for

additional dowry and she was necked out of the

matrimonial home since May 2017. Learned counsel for

the petitioner submits that the complainant is carrying

and he wants his wife back to the matrimonial home.

Therefore, he has not filed any divorce petition nor

intends to separate from his wife. If anticipatory bail is

granted he will appear before the Investigating Officer

and co- operate with the investigation.

4. In the given facts and circumstances of the

case, the petition is allowed. The petitioner is granted

anticipatory bail in Crime No.204/2017 registered by

the respondent police. In the event of his arrest, he shall

be released on bail on executing a self bond for

Rs.50,000/- with one solvent surety for the likesum to

the satisfaction of the concerned Court.
