Counsel for the appellant seeks time to get instructions from the

appellant, if he is able to pay an amount between Rs.15 to 20 lakhs to the

respondent-wife as permanent alimony for parting company with the

respondent-wife as they have been living separately for the last many years.

Adjourned to 14.11.2017.

Heard on application under Section 24 of the Hindu Marriage

Act, filed by the applicant-wife, for grant of pendente lite maintenance and

litigation expenses, wherein the applicant-wife is claiming Rs.15,000/- per

month.

It has been informed that in a petition under Section 125 Cr.P.C.

applicant-wife has been granted maintenance @ Rs.3000/- per month.

Without entering into the controversy regarding the earning

capacity of appellant-husband, it is sufficient to observe that non-

applicant/appellant-husband is working as Clerk in Punjab and Sind bank. In

the interest of justice, it is ordered that applicant-wife will be entitled to a

sum of Rs.5000/- per month with effect from the date of application during

the pendency of the appeal as maintenance pendente lite besides litigation

expenses of Rs.40,000/- payable by the appellant-husband. A sum of

Rs.20,000/- already paid towards litigation expenses will be deductable from

the amount of litigation expenses assessed above.

It is made clear that if the appellant-husband has paid any

amount towards the maintenance determined under Section 125 Cr.P.C.,

relating to the period during pendency of this appeal, the said amount will

be adjustable against the amount determined by this Court from the above

said arrears of maintenance pendente lite.

The application is allowed in the above terms.

The arrear of the maintenance as well as litigation expenses

calculated till 31.10.2017 will be paid in the Court on the date fixed.
