In the matter of: an application for bail under Section 439 of the
Code of Criminal Procedure filed on 04.09.2017 in connection with
Shyampur Police Station Case No. 356 of 2017 dated 01.08.2017
under Sections 498A/307/34 of the Indian Penal Code and Sections
3/4 of the Dowry Prohibition Act added Section 304B/302 of the
Indian Penal Code.

Heard the learned counsel appearing on behalf of the

respective parties. Perused the case diary.

The petitioners are in custody for 39 days. Investigation is in

progress.

On perusal of the statement made by the victim housewife in

presence of the Medical Officer, Medical College and Hospital,

Calcutta, which is at page 26 of the case diary and the roles

attributed to the petitioner nos.1 and 2, namely, Renuka Pramanick

and Astomi Das @ Teri, we are not inclined to allow their prayer for

granting bail.

However, so far as the petitioner no.3 is concerned, our

attentions have not been drawn from the side of the State towards

any materials in the case diary showing necessity in favour of further

custodial detention of the petitioner no.3 or that in the event, bail is

granted in her favour, she is likely to abscond. Therefore, we are

inclined to allow the prayer of the petitioner no.3, namely, Shyamali

Pramanick for granting bail.

Let the petitioner no.3, namely, Shyamali Pramanick, be

released on bail upon furnishing a bond of Rs.10,000/- with two

sureties of Rs.5,000/- each, one of whom must be local, to the

satisfaction of the learned Additional Chief Judicial Magistrate,

Uluberia, Howrah.

The application for bail is, thus, disposed of.
