The petitioner, who is the father-in-law of the complainant,
prays for grant of anticipatory bail in FIR No. 0018 dated 19.04.2017 under
Sections 498A, 406 IPC registered at Police Station Women, District
Bathinda.
It is contended that the petitioner has been falsely implicated in
this case only due to his relationship with the complainant. The complainant
named as many as eleven (11) persons in the FIR. On investigation, nine (9)
persons were found innocent and only two (2) have been proceeded against.
The petitioner’s son has been released on bail pending trial. The allegations
in the FIR are patently incorrect and false. Moreover, the petitioner has
joined investigation pursuant to interim order dated 18.05.2017 passed by
this Court. It is, thus, prayed that this petition be allowed.
Learned counsel for the State verifies that the petitioner has
since joined investigation. It is, however, submitted that one gold ring has
yet to be recovered from him. However, learned counsel for the

petitioner relies on a decision of this Court in Prit Pal Singh versus State
of Punjab and another 2014 (5) RCR (Criminal) 771 to urge that the
concession of anticipatory bail should not be denied merely on the ground
of certain recoveries to be effected.
There are no allegations on behalf of the State that the
petitioner is likely to abscond or that he is likely to dissuade the
witnesses from deposing true facts in the Court, if released on bail.
Keeping in view the facts and circumstances noted above but
without expressing any opinion on the merits of case, it is considered just
and expedient to allow this petition. Consequently, order dated 18.05.2017
is made absolute.
