THIS DAY, THE COURT MADE THE FOLLOWING:

ORDER

These petitioners along with six others are charge

sheeted by the respondent/Police in respect of the

offences under Sections 489B, 120B read with Section

149 of IPC.

2. The allegation is, the accused Nos.1, 6 to 8 were

supplying fake currency notes to accused No.3 and

accused No.9 for circulation. On arrest, three currency

notes of Rs.500/- denomination is recovered from

accused No.5 and 20 currency notes of Rs.500/-

denomination and some old fake notes are recovered from

the possession of these petitioners. A printer is seized

from the possession of 9th accused. The petitioners are in

custody since June 2017.

3. Learned Counsels appearing for the petitioners

submit that no material is collected by the Investigating

Officer about these petitioners indulging in circulation of

fake currency notes. For being in possession of fake

currency notes, offence under Section 489(C) of IPC is

attracted, which is a bailable offence.

However, having regard to the fact that these

petitioners are not attributed of any offence of similar

nature, there is no impediment to allow these petitions.

Accordingly, these petitions are allowed.

Petitioners are enlarged on bail in Crime No.154/2017

registered by the respondent/Police, subject to the

following conditions:

(i) They shall execute self-bond for a sum of
Rs.50,000/- each with one surety for the
likesum to the satisfaction of the concerned
Court.

(ii) They shall attend the Court regularly on all
hearing dates; and

(iii) They shall not threaten the prosecution
witnesses.
