ORAL ORDER

1. Rule.   Mr.Ronak   Raval,   learned   Additional   Public 

Prosecutor, waives service of notice of Rule for the 

respondents.

2. The present application is submitted through the 

father   of   the   convict   for   the   purpose   of   seeking 

temporary bail for a period of thirty days mainly on 

the ground that the examination in which the convict 

has   to   appear   is   related   to   IInd   semester   of   Final 

Diploma Electrical Course and the papers of Switchgear

and   Protections   and   Industrial   Electronics   of   these 

two examinations will be conducted on  09.10.2017 and 

11.10.2017.   For   indicating   this,   the   applicant   has 

attached with the application the documents related to 

the course as well as the exam schedule.

3. For   considering   this   request   made   by   the 

applicant,   we   have   heard   Mr.Ronak   Raval,   learned 

Additional Public Prosecutor and submitted before us 

the Jail remarks which indicate that the applicant has 

not   been  enlarged  on  temporary   bail  earlier   and  his 

conduct in Jail is stated to be good and the applicant 

is   undergoing   life   imprisonment   in   connection   with 

offences punishable under Sections 302 and 498A of the 

Indian Penal Code, 1860 read with Sections 3 and 7 of 

the Dowry Prohibition Act, 1961.

4. Since the Jail conduct of the convict is stated 

to be good and the examination is scheduled to be held 

on   09.10.2017   and   11.10.2017,   we   are   inclined   to 

exercise  our   discretion  in  favour   of   the   convict   in 

part   and   consider   the   request   for   a   period   of   ten 

days.

5. Hence, the following order:

The convict shall be enlarged on temporary bail 

for a period of ten days on furnishing a personal bond 

of Rs.5,000/­ (Rupees Five Thousand Only) and upon the 

usual terms and conditions, to the satisfaction of the 

concerned Jail authority.

Upon   the   expiry   of   the   aforesaid   period,   the 

convict   shall   surrender   before   the   concerned   Jail 

authority forthwith.

6. The   convict   shall   report   to   Manjalpur   Police 

Station on the first and the last day of the temporary 

bail.

7. The   application   is   partly­allowed,   in   the   above 

terms. Rule is made absolute, to the aforesaid extent.

Direct Service of this order is permitted.
