The petitioner seeks pre-arrest bail in case FIR No.23 dated
22.02.2017, registered under Sections 406 and 498A of the Indian Penal
Code, at P.S. City South, Moga.
Contends that the petitioner has joined the investigation in
pursuance of order dated 14.09.2017. A compromise has been reached
between the parties. The petitioner undertakes to pay an amount of Rupees
ten lakh as full and final settlement towards permanent alimony and
maintenance.
Learned State counsel, on instructions, informs that the
petitioner has joined the investigation.
Learned counsel for respondent No.2, on instructions, admits
the factum of the compromise.

Heard.
In view of the above, the petitioner shall pay to
complainant/respondent No.2, an amount of Rupees five lakh within one
month from today as part of the settled amount and the remaining amount of
Rupees five lakh shall be paid on or before 15.05.2018. Learned counsel for
respondent No.2 assures full cooperation as well as presence of respondent
No.2 before the Court(s) as and when required, with regard to filing petition
under Section 13-B of the Hindu Marriage Act and in all other proceedings
pertaining to the marriage between the parties.
Accordingly, without expressing any opinion on the merits of
the case, the interim bail granted by this Court vide order dated 14.09.2017,
is made absolute, subject to furnishing bail bonds/surety bonds to the
satisfaction of the Chief Judicial Magistrate/Duty Magistrate concerned.
The petition stands allowed.
It is made clear that in case, the agreed amount is not paid
within the stipulated period, the present petition shall be deemed to be
dismissed without further notice.
