The instant petition under Section 438 Cr.P.C. has been

filed for grant of anticipatory bail to the petitioner in case FIR no. 49

dated 31.05.2016, under Sections 498A, 420, 343, 506, 120-B, 148, 149

of IPC, registered at Police Station Raja Sansi, District Amritsar Rural.

During the pendency of the petition, the matter was referred

for mediation which has been successful. A settlement agreement has

been arrived at between the parties dated 31.08.2017 and in terms of the

settlement arrived at between the parties, the parties are to obtain divorce

under Section 13-B of the Hindu Marriage Act as well as the petitioner

herein would pay a total sum of ` 15 lacs as permanent alimony as past,

present and future maintenance and compensation etc., to the

respondent-wife. In terms of the said compromise the first installment of

Rs. 2 lacs has been made good by way of demand draft + ` 50,000 in

cash.

In view of the fact that a settlement has been arrived at

between the parties, interim order dated 18.11.2016 is made absolute

subject to the conditions laid down in Section 438, Sub Section (2)

Clauses (i)(ii) and (iii) of the Code of Criminal Procedure.
