This Criminal Petition is filed u/s 438 Cr.P.C
praying to enlarge the petitioners on bail in the event of
their arrest in Cr.No.233/2017 of Srirangapatna Rural
– 3 –

P.S., Mandya District, for the offences P/U/S 143, 147,
323, 341, 498A R/w 149 of IPC.

This criminal petition coming on for Orders this
day, the Court passed the following:

ORDER

Heard the learned counsel for the

petitioners/accused Nos.1 to 8 and the learned High

Court Government Pleader for respondent-state.

2. Petitioners apprehend their arrest in Crime

No.233/2017 registered by the respondent-police in

respect of the offences punishable under Sections 143,

147, 341, 323, 498A and 149 of IPC.

3. The 1st petitioner is the husband of the

complainant and petitioner nos.2 to 8 are his family

members. In fact they were granted anticipatory bail by

the Sessions Court with a direction to appear before the

respondent-police within 7 days of the said order.

4. Sri.N.M.Puttamade Gowda, learned counsel

appearing for the petitioners submits that because of ill-

health of petitioners No. 1, 4 and 5 they could not

surrender before the Investigating Officer within seven

days of the order of learned Sessions Court. If

anticipatory bail is granted, they will appear before the

Investigating Officer and co-operate with the

investigation.

5. Accepting the reasons assigned for non

compliance of the conditions imposed on them by the

Sessions Court, petition is allowed. Petitioners are

granted anticipatory bail in Crime No.233/2017 subject

to the condition that the petitioners 1, 2, 3, 4 and 5

shall appear before the Investigating Officer forthwith.

In that event, Investigating Officer is at liberty to

interrogate them.

6. In the event of arrest of the petitioners No.1

to 8, they shall be released on bail on each of them

executing a self bond for Rs.50,000/- with one surety

for the likesum to the satisfaction of the concerned

Court. They shall not dispossess the complainant from

her matrimonial home and shall not threaten or prevail

upon her.
