Prayer in this petition is for quashing of criminal complaint No.
37378/2013 dated 25.07.2013 under Sections 323, 406, 498A, 506, 34 IPC
as well as summoning order dated 07.11.2015.
At this stage, learned counsel for the petitioners seeks to
withdraw this petition. It is, however, submitted that liberty be afforded to
the petitioners to approach the learned trial Court for exemption from
personal appearance on the ground of various ailments from which the
petitioners suffer, duly supported by the affidavit of the petitioners along
with supporting medical certificates.
Dismissed as withdrawn with liberty as aforementioned.
In case, an application for exemption from personal appearance
is moved by the petitioners in a proper form, duly supported by affidavits of
the petitioners along with the requisite medical record, the same be
considered sympathetically by the learned trial court in accordance with
law.
