Heard the learned counsels appearing for the parties and 

perused the documents on record.

Seeking   grant   of   bail   in   S.T.   No.251   of   2017   the 

petitioner has approached this Court. Vide order dated 19.07.2017 

passed in B.A. No.5630 of 2017, the petitioner was granted liberty 

to approach this Court after framing of the charge. Now, charges 

have   been   framed   against   the   petitioner   and   other   co­accused 

persons on 07.09.2017.

Ichak   P.S.   Case   No.228   of   2012     was   registered   for 

offences   under   sections   147/448/341/323/307/354/504/379   of 

the Indian Penal Code. 

The  incident has occurred in two phases. The persons 

who   are   accused   of   participating   in   the   second   phase   of   the 

incident   for   which   charge   has   been   framed   for   offence   under 

section 307 I.P.C. also, all have been granted anticipatory bail by this 

Court   vide   order   dated   08.12.2015   passed   in   A.B.A.   No.3931 

of   2015   and   order   dated   04.05.2016   passed   in   A.B.A.   No.929 

of 2016.

Insofar as, allegation against the petitioner in the first

part of the incident is concerned, it is alleged that he dragged the 

victim inside the room and tried to commit rape upon her. It is also 

alleged that he has snatched golden chain of the victim. The offences 

punishable   under   sections   379   and   354   I.P.C.   are   triable   by 

Magistrate   and   for   the   offence   under   section   354   I.P.C.   maximum 

sentence is five years. The petitioner is in custody since 20.06.2017.

Considering the period of custody of the petitioner and 

having   regard   to   the   facts   and   circumstances   of   the   case,   the 

petitioner,   Yogendra   Singh,   is   directed   to   be   released   on   bail   on 

furnishing bail bond of Rs.10,000/­(Rupees ten thousand) with two 

sureties of the like amount each, one of the bailers shall be class­I 

legal   heir   of   the   petitioner,   to   the   satisfaction   of   the   learned 

Additional Sessions Judge­IX, Hazaribagh in connection with Ichak 

P.S.   Case   No.228   of   2012   corresponding     to     G.R.   No.4845   of 

2012(S.T. No.251 of 2017), with the condition that he shall appear 

before the trial court regularly during the trial.

  The instant application is allowed. Let a copy of the order 

be transmitted to the trial Court through ‘Fax’.
