This bail application has been filed under Section 439 CrPC in

connection with CR No.78/17, registered at Police Station Nagana,

Barmer for the offence under Section 498A, 306 IPC.

Learned counsel for the petitioner states that the

accused-petitioner has been falsely implicated in the case. The

conclusion of trial will take time, hence the accused petitioner

deserves to be granted indulgence of bail under Section 439

Cr.P.C.

Learned PP and learned counsel for complainant

opposed the bail application.

Heard learned counsel for the petitioner and learned

Public Prosecutor appearing for the State as well as learned

counsel for complainant and carefully perused the relevant

material made available on record.

Taking into consideration overall facts and

circumstances of the case but without expressing any opinion on

the merits and demerits of the case, I deem just and proper to

enlarge the petitioner on bail.

Therefore, this bail application is allowed and it is

directed that accused petitioner Vijay Kumar S/o Chutra Ram,

shall be released on bail under Section 439 CrPC in connection

with aforesaid FIR provided he furnishes a personal bond of

Rs.20,000/- with two sureties in the like amount to the

satisfaction of the concerned Magistrate with the stipulation that

he shall comply with all the conditions laid down under Section

437(3) CrPC.
