Prayer in this petition is for grant of anticipatory bail to the
petitioner in FIR No. 1 dated 03.01.2017 under Section 498A IPC registered
at Police Station Women, Sector 17, Chandigarh.
It is submitted that the parties have amicably resolved the
dispute before the Mediation and Conciliation Centre of this Court.
Settlement/agreement dated 11.09.2017 is attached with this file. Petition
under Section 13B of Hindu Marriage Act, 1955 has been filed by the
petitioner and respondent No. 2. Their statements at first motion have been
recorded and part of the settled amount remitted by the petitioner. The
petitioner undertakes to abide by the terms and conditions of the settlement
in letter and spirit. It is, thus, prayed that this petition be allowed.

Learned counsel for respondent No. 2 affirms and verifies the
factum of settlement between the parties and submits that respondent No. 2
has no objection, in case, this petition is allowed subject to strict adherence
by the petitioner to the terms and conditions of the settlement.
Learned counsel for the U.T. Chandigarh verifies that the
petitioner has joined investigation.
Keeping in view the facts and circumstances noted above,
especially the settlement between the parties, but without expressing any
opinion on the merits of case, it is considered just and expedient to allow
this petition. Consequently, order dated 22.03.2017 is made absolute.
However, liberty is afforded to respondent No.2 to move an
appropriate application in this matter, in case the terms and conditions of
settlement between the parties are not adhered to by the petitioner.
