Appellant had filed a petition under the Guardian and Wards

Act for the custody of minor son Jasjot Singh. The said petition was decided

by Civil Judge (Senior Division), Patiala, exercising the powers of

Guardian Judge, on 15.09.2014 dismissing the petition, however granting

meeting rights to the appellant to see the minor child on Saturdays at

appropriate hours.

The main case is listed for 17.01.2018.

Civil miscellaneous application No.25383-CII of 2017 has

been filed for preponing the date of hearing on the ground that the matter

has been compromised between the parties and that the parties would be

bound by the terms of said compromise.

Civil miscellaneous application No.25384-CII of 2017 is

allowed.

09.10.2017 has been placed on record as Annexure A-12. The settlement

arrived at between the parties is taken on record as Exhibit CX. It is

ordered that it will be made part of the record. The date of hearing is

preponed from 17.01.2018 for today.

Counsel for the respondent has admitted that as per the terms

and conditions of the settlement, the custody of the minor child has been

handed over to the appellant-wife.

The appeal is allowed in terms of the settlement arrived at

between the parties by setting aside the impugned judgment. They will be

governed by the terms and conditions of settlement agreement Exhibit CX.
