Heard learned counsel for the accused-petitioner and learned

Public Prosecutor.

It is submitted by learned counsel for the accused petitioner

that the accused petitioner was arrested in connection with

offence under Section 498A 306 IPC and during investigation, a

suicide note of deceased Rekha Kumari was recovered in which no

allegations was levelled by her against the accused petitioner. It

is stated by her that she is committing suicide due to doubt upon

the petitioner to have illicit relation with other girl. It is argued by

the learned counsel that it is not a case in which factum of

abetment is disclosed by reliable evidence, therefore, the accused

petitioner, who is in judicial custody, may kindly be enlarged on

bail.

Learned Public Prosecutor vehemently opposed the prayer of

the learned counsel for the petitioner.

Having regard to the facts and circumstances of the case and

upon a consideration of the arguments advanced at the bar, this

Court is of the opinion that the bail application filed by the

petitioner deserves to be accepted.

Consequently, without expressing any opinion on the merits

of the case, the bail application is allowed. It is ordered that the

accused-petitioner, Joga Ram @ Dhyan Chand S/o Shri Heera

Ram arrested in connection with F.I.R. No.97/2017 of Police

Station-Bagra, District Jalore shall be released on bail; provided

he furnishes a personal bond of Rs.50,000/- and two surety bonds

of Rs.25,000/- each to the satisfaction of the learned trial court

with the stipulation to appear before that Court on all dates of

hearing and as and when called upon to do so
