It is submitted on behalf of the petitioner that he has been suffering from kidney

ailment and was admitted in the hospital at the time of occurrence.

Learned lawyer for the State opposes the prayer for bail and submits that he

demanded money from the victim for his treatment.

We have considered the materials on record and we find that the petitioner was

admitted in hospital at Bangalore for treatment at the time when the incident occurred.

In view of the aforesaid facts and bearing in mind the precarious health

condition of the petitioner, we are inclined in granting anticipatory bail to the petitioner.

In the event of arrest, the petitioner shall be released on bail upon furnishing

bond of Rs.10,000/- (Rupees Ten Thousand only) with two sureties of like amount each

to the satisfaction of the arresting officer subject to the conditions as laid down under

Section 438(2) of the Code of Criminal Procedure, 1973.

The application for anticipatory bail is, accordingly, allowed.

Urgent photostat certified copy of this order, if applied for, be supplied

expeditiously after complying with all necessary legal formalities.
