Issue show cause notice to the respondent on payment of process

Petitioner by filing this petition has challenged the grant of
maintenance to the child because under Section 24 of the Hindu
Marriage Act the maintenance pendente lite is permissible either to the
husband or to the wife.
Considering the aforesaid, till next date of hearing, operation of
the impugned order dated 7.9.2017 Annexure P/1 so far as it relates to
grant of maintenance to the child shall remain stayed, however, it is
made clear that staying of grant of maintenance to the child would not
debar the respondent to take recourse under Section 125 of Cr.P.C. or
under any other provisions of law that includes the provisions of
Hindu Adoption and Maintenance Act. The order impugned so far as it
relates to grant of maintenance to respondent is not stayed by this
