THE HIGH COURT OF MADHYA PRADESH
(DEEPAK TIWARI Vs SMT. NIDHI TIWARI)
Jabalpur, Dated : 31-01-2018
Shri Shankar Dayal Sharma, counsel for the petitioner.
Assailing the order of grant of maintenance pendente lite
allowing an application under Section 24 of the Hindu Marriage Act
by the trial Court, this petition under Article 227 of the Constitution of
India has been preferred by the petitioner who is the Assistant
After perusal of the order impugned and as admitted before the
Court that the petitioner is getting Rs.28,000/- per month salary,
however, in such circumstances if Rs.7,500/- is awarded towards
maintenance pendente lite to wife is just, in my considered opinion,
trial Court has not committed any error warranting interference in
exercise of the power under Article 227 of the Constitution of India.
Accordingly devoid on merit, petition stands disposed of.
