Petitioner is aggrieved of the order dated 4.5.2017 (Annexure

P1), passed by learned Additional District Judge, Kaithal, vide which,

pending the disposal of the petition filed under Section 13 of the Hindu

Marriage Act, 1955, the trial Court, while deciding application under

Section 24 of Hindu Marriage Act, 1955, awarded the maintenance

pendente lite @ Rs.18,000/- per month to the respondent-wife.

I have heard learned counsel for both the parties.

Learned counsel for the petitioner has pressed the petition only

on the quantum. It is contended that as per pay slip of the petitioner for the

month of June 2017 (Annexure P5), he is getting net pay of Rs.37,503/-.

His basic salary is Rs.61,300/-, out of which, a recovery of Rs.26,130/- is

being made and total entitlements comes to Rs.51,689/-. From the said

entitlements, further deductions of Rs.14,186/- is being made.

Considering the facts and circumstances and the net pay, the

interim maintenance is reduced from Rs.18,000/- per month to Rs.12,000/-

per month. Remaining part of the order is maintained.

The present revision petition is accordingly partly allowed.

However, the trial Court is directed to expedite the disposal of the petition

and dispose of the same maximum within one year.

Litigation expenses deposited in terms of the order dated

23.8.2017 passed by this Court be released to the respondent.
