ORAL ORDER

1. The present petition has been filed by the
petitioner – husband challenging the order dated
05.08.2016 passed by the Family Court, Surat
below Exh. 9 in Family Suit No. 769 of 2016,
whereby the Family Court has directed the
petitioner to pay Rs. 6,000/- towards maintenance
to the respondent – wife and Rs. 4,000/- towards
maintenance pendente lite for the minor son from
07.04.2017.

2. It is submitted by the learned advocate Mr.
Mehta for the respondent that out of the total
amount of maintenance, the petitioner has

deposited only Rs. 40,000/-, whereas the arrears
is more than Rs. 1 lac. However, the learned
advocate for the petitioner states that the
petitioner be granted some more time to clear the
arrears.

3. Having regard to the submissions made by the
learned advocates for the parties and documents
on record, more particularly the impugned order
passed by the Family Court, the Court is not
inclined to interfere with the same at this
stage, the same being interlocutory in nature.
However, the Family Court is directed to dispose
of the main Family Suit as expeditiously as
possible and preferably within six months from
the date of receipt of copy of this order.

4. Subject to the said direction, the petition
is disposed of.
