Shri Dinesh Kumar Maheshwari, learned counsel for the
appellant.

Shri Prateek Maheshwari, learned counsel for the
respondent.

Heard on IA No.15287/2017, an application for grant of
maintenance pendente lite filed by the respondent/wife.

Learned counsel for the respondent has submitted that the
appellant is doing the business of wholesale cloths in the name
of “Saraswati Hosiery” and his income is more than 1 lakh per
month. He has also drawn our attention to the telephone bill,
electricity bill, medical bills and submitted that looking to the
status of the appellant the sum of Rs.50,000/- per month be
awarded as maintenance.

Per contra, learned counsel for the appellant has drawn
our attention to the detailed reply and submitted that the income
of the appellant is Rs.8,000/- per month. The father of the
appellant is bearing the education expenses of the child of
appellant, looking to the fact that the income of the appellant is
Rs.8,000/- per month, the sum of Rs.4,000/- be awarded to the
respondent/wife.

On due consideration the arguments of the learned
counsel for the parties and looking to his status, we allow the
maintenance pendente lite of Rs.5,000/- per month to the

respondent/wife and direct the appellant to pay the amount @
Rs.5,000/- per month from the date of application and
Rs.15,000/- towards the litigation expenses. Arrear of
maintenance pendente lite be paid within the period of six
weeks from today and he will regularly pay the amount of
Rs.5,000/- per month during the pendency of the appeal and till
the First Appeal is finally decided.

With the aforesaid, IA No.15287/2017 is allowed in part
and disposed of .
