This petition has been filed under Section 439 Cr.P.C. seeking
regular bail to the petitioner in a case FIR No.29 dated 26.04.2017 under
Section 377 IPC and Section 4 of Protection of Children from Sexual
Offences Act, 2012 at Police Station Ghanaur, District Patiala.
Learned counsel submits that the petitioner is in custody since
03.05.2017. Trial may take some time to conclude.
Learned counsel for the State has opposed the prayer for bail.
He submits that trial has made some headway as out of 16 witnesses cited by
the prosecution, 07 have been examined.
Heard.
Keeping in view the period of his incarceration and the fact that
trial may still take some time to conclude, no useful purpose would be
served by detaining the petitioner in custody any longer. Thus, without
expressing any opinion on the merits of the case, this petition is allowed and
the petitioner is directed to be released on bail to the satisfaction of Chief
Judicial Magistrate/Duty Magistrate, Patiala.
