Petitioner seeks transfer of petition filed under Section 25/29/8

of the Guardian and Wards Act, 1890, titled as “Dharinder Kumar vs

Kavita Verma”, pending in the Court of learned Civil Judge (Sr. Divn.),

Patiala, to a Court of competent jurisdiction at Bhiwani.

Learned counsel for the petitioner states that the minor never

resided at Patiala. Therefore, the Guardian Judge at District Courts, Patiala

has no jurisdiction.

It is further contended that due to distance of 240 Kms.

between Patiala and Bhiwani, petitioner is unable to pursue her case at

District Courts, Patiala.

On the other hand, it is not denied that the objection regarding

the jurisdiction at Patiala Courts has taken before the learned Guardian

Judge, who has framed the issue regarding the same and is yet to take a

decision.

The petition is pending since the year 2014 before the learned

Guardian Judge, Patiala and the present petition has been filed in the year

2017.

Since, the learned Guardian Judge, is yet to take decision as to

whether it has got jurisdiction and the same point is being pressed here,

therefore, at this stage, this Court does not find any ground to transfer the

aforesaid case to any other court.

As such, the present revision petition is dismissed.
