The petitioner is seeking regular bail in FIR No. 0008 dated

09.01.2018, registered under Sections 376/511/452 IPC, Police Station

Lakhan Majra, District Rohtak.

Counsel for the petitioner contends that the petitioner is in

custody since 17.01.2018 and investigation is over and challan has been

presented and the FIR was lodged for different reasons and the

complainant has now made a statement withdrawing the allegations.

Counsel refers to the Hindi version of the FIR to show that it was not a

case of attempt to rape and at the most a case under Section 354 IPC. It

was urged that the complainant has made a statement under Section 164

Cr.P.C. and has stated that she had given the complaint under mis-

conception and she did not want any action on her complaint. Copy of

the statement was placed on record.

A complaint was made by the married woman. She has

withdrawn all the allegations on the next date. Her statement under

Section 164 Cr.P.C. has been recorded. The Challan has already been

presented. The trial will take time to conclude. Without commenting

upon the merits of the case, the petition is allowed and the petitioner is

directed to be released on regular bail on execution of adequate personal

and surety bonds to the satisfaction of trial Court/Duty Magistrate.
