The petitioner is seeking regular bail in FIR No. 20 dated

21.01.2018, registered under Sections 148, 149, 323, 341, 427 506 of IPC

(Section 354 IPC added subsequently), Police Station Sadar Amritsar, District

Amritsar.

The case was adjourned on the last date to enable the petitioner

to place on record the complaint made by their side. Today a complaint said

to have been given by Ranjit Kaur has been placed on file, which according

to them had been given to the Police Commissioner on 16.03.2018. The

counsel for the petitioner has also placed on record FIR No. 40 registered on

25.01.2018. He states that when Tarsem Singh one of the accused in this FIR

was being taken to the Court when the lawyers had attacked him.

The counsel for the petitioner urges that all the offences are

bailable and supplementary statement was made and the petitioner is ready to

join the investigation.

On the last date, a video had been played in the Court, which

was captured by someone who was standing on the roof. The trial Court has

also referred to it in its order. The incident had occurred when a three-wheeler

and a car had collided. The driver of the car got out and was speaking to the

driver of the three-wheeler when the passengers of the three-wheeler who

were all related, started beating the complainant. The video shows that a

group consisting of men and a woman pulled out the inmates of the car. One

of the occupant of the car was a lawyer who had made a statement that her

modesty had been outraged. The cross version is said to have been given by

Ranjit Kaur who alleged that she also suffered injuries on her little finger and

there was a fracture. The complaint was given by her after two months of the

incident. No FIR has been registered on her complaint yet. It is not a

complaint but a representation to the Commissioner of Police, which has been

given after the dismissal of the bail application filed by the petitioner. The

lawyer, her brother and the complainant (driver of the car) were beaten up by

people who were carrying kirpans and iron rods. Ranjit Kaur in her

representation to the police has admitted to the presence of the petitioner.

Considering the allegations and the manner in which the occurrence has taken

place, I am not inclined to exercise the discretion and grant anticipatory bail.

The petition is dismissed.
