Heard learned counsel for the parties.

This is an appeal under Sections 14(A)(2) of the

Scheduled Castes and Scheduled Tribes (Prevention of

Atrocities) Act, against refusal of the prayer for bail by the

learned Additional District Judge-I-cum-Special Judge SC/ST

Act, Sitamarhi in connection with Nanpur P.S.Case No. 276 of

2016 registered under Sections 498A,34 of the Indian Penal

Code, Section 3/4 of D.P.Act as well as under Sections 3(x) of

the Scheduled Castes and Scheduled Tribes Act.

It appears that husband of respondent No.2, who is

co-accused in this case has already been allowed bail by a
Patna High Court CR. APP (SJ) No.1515 o f 2018 dt.14-05-2018

Coordinate Bench of this Court in Cr.Appeal (SJ) No.2141 of

2017. The appellants are relations of the husband. Allegation is

under Section 498A of the Indian Penal Code and 3/4 of Dowry

Prohibition Act. Appellants are in custody since 30.01.2018.

Considering the aforesaid facts, let the appellants,

above named, be released on bail on furnishing bail bond of

Rs.20,000/- (Twenty Thousand) each with two sureties of the

like amount each to the satisfaction of the learned Court-below

where the case is pending in connection with the aforesaid case,

with condition that the appellants shall fully cooperate with the

investigation/trial of the case, failing which the court below

shall be at liberty to cancel the bail bond of the appe llants.

Accordingly, the appeal stands allowed.
