This is a petition filed under Section 24 of the Code of Civil

Procedure, 1908, seeking transfer of the petition No. GW/18 filed by

respondent-husband under Section 25 and 10 of the Guardians and Wards

Act, 1890 titled as “Gaurav Ghai versus Sheenu Ghai” pending in the

Court of learned Civil Judge, (Senior Division), Fatehgarh Sahib to a Court

of competent jurisdiction at Ludhiana.

Heard.

Learned counsel for the petitioner contends that respondent-

husband has filed a petition under Section 25 of the Guardians and Wards

Act, 1890 for custody of the minor child namely Hardik Ghai. It is further

submitted that children and wife are living at Ludhiana.

As per Section 9 of the Guardians and Wards Act, 1890, the

petition is to be tried at a place where the children are residing. Since the

children are residing at Ludhiana, only Ludhiana Court has got the

jurisdiction. As Such, the petition No. GW/18 filed by respondent-husband

under Section 25 and 10 of the Guardians and Wards Act, 1890 titled as

“Gaurav Ghai versus Sheenu Ghai” pending in the Court of learned Civil

Judge, (Senior Division), Fatehgarh Sahib is withdrawn from the said Court

and transferred to the Court of Civil Judge, (Senior Division), Ludhiana for

disposal.

In view of above, petition stands allowed.
