THE COURT MADE THE FOLLOWING:

ORDER

Heard the learned counsel for the petitioners and

perused the records.

2. The petitioners have sought for quashing of the

entire proceedings in CC No.459/2015 for the offence

punishable under sections 498A, 506 and 149 of IPC and

also u/s.3 4 of Dowry Prohibition Act.

3. The order sheet of the trial Court discloses that,

on 7.9.2015, the petitioners have already filed an

application u/s.245 read with Section 239 of Cr.P.C.

seeking for discharge in the said case. However, the said

application has not yet disposed of, though that application

was filed in the year 2015. In the above said

circumstances, the petitioners are at liberty to press that

application before the trial Court.

4. The trial Court is hereby directed to hear the said

application after providing opportunity to the other side

and dispose of the same as expeditiously as possible within

one month from the date of receipt of a copy of this order.

5. With the said observation, this Petition stands

disposed of.

In view of disposal of the Petition on merits,

I.A.No.1/2018 filed for stay does not survive for

consideration and the same stands dismissed.
