The present bail application has been filed under Section 439

Cr.P.C. on behalf of the petitioner who is in custody in connection

with F.I.R.(CR) No.70/2018, Police Station-Banar, District Jodhpur

for the offence under Sections 498A and 306 IPC.

Since the lawyers are abstaining from work, heard, Ms Sita

Devi (daughter of the petitioner), Mr. Badri Ram (complainant) as

well as learned Public Prosecutor and also perused the material

available on record.

As per the statement of Kumari Pooja who is daughter of the

deceased, grandfather and grandmother have not tortured the

deceased nor there was any fight between them. The police has

filed challan after completion of the investigation in the matter.

Learned Public Prosecutor as well as the complainant have

vehemently opposed the bail application.

Having regard to the facts and circumstances of the case and

upon a consideration of the arguments advanced, this Court is of

the opinion that the bail application filed by the petitioner

deserves to be accepted.

Consequently, the bail application is allowed. It is ordered

that the accused-petitioner Bhiri Devi W/o Shri Bhairaram arrested

in connection with F.I.R.70/2018, P.S. Banar, Jodhpur shall be

released on bail; provided she furnishes a personal bond of

Rs.50,000/- with two surety bonds of Rs.25,000/- each to the

satisfaction of the learned trial court with the stipulation to appear

before that Court on all dates of hearing and as and when called

upon to do so.
