In Re: – An application for anticipatory bail under Section 438 of
the Code of Criminal Procedure filed on 07/06/2018 in
connection with Arambagh P.S. Case No. 221 of 2018 dated
21/04/2018 under Sections 147 /148 /447 /323 /325 /498A
/406 /420 /504 /34 of the Indian Penal Code.

And

In the matter of: Subal Chandra Dutta Ors.

….petitioners.

Mr. Sk. A. Jafor
…for the petitioners.

Ms. K. Mitra
…for the State.

It is submitted on behalf of the petitioners that the

incident arose out of a dispute between the defacto complainant

and the petitioners and his relations including his children

arising from an earlier marriage.

Learned counsel appearing on behalf of the State opposes

the prayer for anticipatory bail.

Having considered the materials in the case diary and

bearing in mind the nature of allegations in the light of the

aforesaid submissions made on behalf of the petitioners, we are

of the opinion that custodial interrogation of the petitioners is

not necessary and they may be granted anticipatory bail.

In the event of arrest, the petitioners shall be released on

bail upon furnishing a Bond of Rs. 10,000/- each with two

sureties of like amount to the satisfaction of the Arresting Officer

and also subject to the conditions as laid down under Section

438(2) of the Code of Criminal Procedure, 1973 and on further

condition that petitioner nos.1, 2 6 shall meet the investigating

officer once in a week until further orders.

The application for anticipatory bail is, thus, disposed of.
