The petitioner being the husband of the opposite party no. 2, Indu Sahu
has filed this revisional application for quashing of the entire proceedings drawn
up in connection with G.R. No. 2513 of 2017 corresponding to New Town Police
Station Case No. 371 of 2017 dated July 29, 2017 under Section 498A of the
Indian Penal Code, 1860 pending before the learned Chief Judicial Magistrate,
Barasat.
At this stage, the opposite party has filed written instruction to this effect
that she had filed the case in question against her husband under Section 498A
of the Indian Penal Code but now she is residing with her husband who have
jointly filed the compromise petition being CRAN 5382 of 2017 arising out of this
revisional application being CRR 4033 of 2017.

In consideration of the petition of compromise and the spouse living
peacefully with the marital harmony, I do not find the continuation of the case
pending before the learned trial Court would subserve the purpose of justice. So
in order to maintain spontaneous relationship between the parties, let both the
revisional application and the compromise petition being CRR 4033 of 2017 and
CRAN 5382 of 2017 be disposed by quashing the entire proceedings in
connection with G.R. No. 2513 of 2017 corresponding to New Town Police Station
Case No. 371 of 2017 dated July 29, 2017 under Section 498A of the Indian
Penal Code, 1860 pending before the learned Chief Judicial Magistrate, Barasat.
With the above direction CRR 4033 of 2017 and CRAN 5382 of 2017 are
disposed of.
Urgent xerox certified copy of this order, if applied for, be supplied to the
parties after completion of all formalities.
