This Criminal Petition is filed under Section 439 of
the Code of Criminal Procedure praying to allow the
2 Crl.P.No.200525/2018

petition and order for release of the petitioner on bail in
C.C.No.1315/2018 pending on the file of the learned
I Addl. Civil Judge and JMFC-II Court at Bidar arising out of
Crime No.6/2018 of Women Police Station, Bidar for the
alleged offence punishable under Sections 498A, 306 and
109 read with Section 34 of IPC.

This petition is coming on for orders this day, the
Court made the following:

ORDER

Heard.

2. Petitioner is accused No.2 in Crime

No.6/2018 of Bidar Women Police Station. Petitioner

and his younger brother are charge sheeted in the

said case for the offences punishable under

Sections 498A, 306 and 109 read with Section 34 IPC.

3. The marriage of the first accused was

performed with the victim – Jyothi on 24.02.2016. It

is alleged that accused No.1 was harassing her stating

that she is not good looking and does not know how to

work and he contracts second marriage. It is alleged

that the accused abandoned the victim in her parent’s

house and did not take her back and being frustrated

by that, she committed suicide on 27.01.2018 at

5.00 p.m. in her parent’s house in Bidar. The

allegations of insulting, annoying the victim and

threatening of second marriage are against the first

accused.

4. As per the prosecution victim has left

suicide note in that also she has implicated only the

first accused. Petitioner is in judicial custody since

22.02.2018. Under these circumstances, it is a fit case

to grant bail to the petitioner with suitable conditions.

The petition is allowed accordingly.

5. The petitioner is granted bail in Crime

No.06/2018 of Bidar Women Police Station, which is

now pending in C.C.No.1315/2018 before the I Addl.

Civil Judge and JMFC-II Court, Bidar.

6. The petitioner shall be released on bail in

the said case subject to the following conditions ;-

1. The petitioner shall execute personal
bond in a sum of Rs.25,000/- (Rupees
Twenty Five Thousand only) and furnish
two sureties in the likesum to the
satisfaction of the
Magistrate/Investigating Officer.

2. He shall appear before the Court
regularly as and when required and
co-operate for trial.

3. He shall not tamper the prosecution
witnesses by threats, inducement or
otherwise.
